Version 1.0. Effective 16 October 2026.

1. About these terms

These terms apply to every quote, order and supply of goods and services by Steel Frame Manufacturing Limited (NZBN 9429051681876) of 29 Studholme Street, Waimate 7924 (“SFML”, “we”, “us”). By accepting a quote, paying an invoice or placing an order on our website, you agree to them.

If you are buying for personal, domestic or household use, nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Building Act 2004 or any other law that cannot be excluded. Where a term conflicts with one of those rights, the right prevails.

A written quote or signed contract from SFML overrides these terms where the two conflict. We may update these terms from time to time. The version in force when we accept your order applies to that order.

2. Definitions

  • Goods: steel frames, trusses, kitsets and ancillaries (screws, brackets and similar) we supply.
  • Kitset: a predesigned framing kit listed on our website, supplied to the specification on its product page.
  • Custom Order: frames we detail and manufacture to your plans.
  • Services: design and detailing, engineering coordination, and on-site support.
  • Drawings: our 3D models, shop drawings, layouts, schedules and cutting lists.
  • Consumer: a customer buying for personal, domestic or household use.
  • Business Customer: a customer buying for business purposes, including builders and contractors.
  • Order: a quote you have accepted, or an order you have placed and we have confirmed.
  • You: the person or company placing the Order.

3. Quotes, orders and acceptance

A quote is valid for 30 days unless it says otherwise. Early pricing is based on basic modelling, an engineering review and a schedule of quantities from the plans you give us. If detailing or engineering shows the quantities or design need to change, we will tell you and re-quote before we proceed.

You can accept a quote by email or phone. We accept a Custom Order once we have confirmed with you that we hold the latest set of plans, set up the job and delivery timeframes, and issued the deposit invoice. We accept a website Kitset order when we send you an order confirmation. We may decline any order, in which case we refund anything you have paid.

You must make sure the plans and information you give us are the current approved set. Website prices include GST. If a price on our website is clearly wrong, we may cancel the order and refund you in full.

Products we buy in. We buy cladding, roofing and other products from other suppliers. If a supplier’s price rises, or a product becomes unavailable, before we have ordered it, we will tell you. You may then accept the new price, accept a substitute of equal or better specification, or cancel that item and receive a refund of what you paid for it. Colour and finish can vary between batches and from samples or screens.

4. Design, engineering and sign-off

For Custom Orders we detail the steel frames, arrange the engineering producer statement (PS1) and give you our 3D model to review and sign off before we manufacture.

Your information. You are responsible for giving us accurate and complete plans, dimensions, site conditions, wind and snow zones, loadings and any consent conditions. We are not responsible for errors in information you supply.

Sign-off. When you sign off the 3D model or Drawings, you confirm that the dimensions, openings, layout and quantities are correct. Changes after sign-off are at your cost and may delay delivery. Once manufacture has started we may refuse changes.

Kitsets. Kitsets are designed to the specification on their product page. Before you order, you or your designer must confirm the Kitset suits your site, foundations, wind and snow zone and consent requirements. Where a product page says a PS1 is included, it covers the design of the framing as supplied only, not your site, foundations or other building elements. Site-specific engineering is quoted separately.

Engineering. PS1 and PS3 documentation is provided on request. A producer statement applies only to the work it describes, with the framing exactly as designed and supplied.

Estimates. Any cladding, roofing or other material quantities we give you are estimates to help you plan and price. Check them against your plans before ordering, and allow for waste and site conditions. We are not responsible for a shortfall or surplus based on an estimate unless our quote says the quantity is guaranteed.

5. Price, GST and payment

All prices are in New Zealand dollars. Website prices include GST. Quotes state whether GST is included.

Custom Orders are invoiced in two stages:

  1. A deposit invoice for 50% of the total at acceptance, which starts the design work.
  2. A final invoice for the remaining 50% once the frames have been manufactured.
  3. The final invoice must be paid in full before the frames leave our yard.

Kitsets bought on our website are paid in full at checkout.

We may hold the goods until we are paid in full. Payment methods are shown on your invoice or at checkout.

If the final invoice is still unpaid 30 days after its date (for example, where we have agreed to release the goods before payment), we may charge interest at 6.95% per annum from that day until paid, and recover our reasonable costs of collecting it. Extra work outside the agreed scope is a variation: we will quote it in writing and start it only once you accept.

6. Cancellation, refunds and returns

This section works together with our Refund & Return Policy. If they differ, the more favourable one to you applies.

Cancelling. You may cancel an Order within 7 days of your first payment by telling us in writing (email is fine). We will refund what you paid, less the cost of the detailer’s time already spent on your design and any engineering fees we have already incurred. We will show you how we calculated the deduction.

After 7 days. Frames are made to your approved design, so we do not refund cancellations made more than 7 days after your first payment. This does not apply if we are unable to supply the goods, or if the law gives you a right to a refund.

Returns and exchanges. We do not accept returns or exchanges of goods that match your approved Order. Goods that are faulty or do not match the Order are dealt with under section 11.

Damage in transit. Tell us within 2 business days of delivery, with photos. If a frame or component was damaged in transit, we will send a replacement within 5 days of your notification.

Refunds are paid to the original payment method within 10 business days of being agreed.

7. Delivery, risk and inspection

We deliver nationwide to the address you give us. Delivery timeframes are confirmed when we accept your Order and are estimates, not guarantees. Unless your quote says otherwise, prices do not include freight, installation or labour. Delivery charges are shown on your quote, invoice or at checkout.

You must make sure the site has safe, clear access for a heavy delivery truck and, where needed, a crane or forklift. You are responsible for unloading. If we cannot deliver because of site access, or the delivery is delayed by you, we may charge waiting time and re-delivery costs.

Risk in the goods passes to you when they are delivered to your site, or when they leave our yard if you collect them or arrange your own carrier. Ownership passes under section 8.

Check the goods against your delivery docket when they arrive. Note any visible damage or shortage on the docket and tell us within 2 business days, with photos. This does not limit your rights under section 11 or the law.

8. Retention of title

Ownership of the goods stays with SFML until we have received payment in full for them. Until then you hold the goods for us, must keep them identifiable and in good condition, and must not sell, pledge or build them into a structure without our written agreement unless you have paid.

If you are a Business Customer and do not pay when due, we may, after giving you reasonable written notice, enter the premises where the goods are held, during business hours, to recover goods that have not been built into a structure.

We may register a security interest in the goods on the Personal Property Securities Register. If you are a Business Customer, you waive your right to receive a verification statement under the Personal Property Securities Act 1999.

9. Your responsibilities

Consents and compliance. You (or the building owner) are responsible for deciding whether building or resource consent is required, applying for it, and meeting its conditions. Buying our goods does not mean a consent will be granted or that the finished building complies with the Building Code.

Site and foundations. Foundations and the site must be accurate, level and built to the engineer’s or designer’s requirements. Our frames are designed for the foundation and site conditions stated in the approved design.

Installation. Frames must be installed in line with the approved Drawings, connection details and engineer’s instructions, by suitably skilled people. Some work is restricted building work that the Building Act 2004 requires to be carried out or supervised by a Licensed Building Practitioner. You are responsible for the safety of your site and of the people working on it.

Storage and handling. Store goods off the ground, dry, covered and clear of wet concrete, treated timber and other materials that can corrode steel. Do not cut, drill or alter frames without our engineer’s written approval. Unapproved changes void the producer statements and our warranty on the affected framing.

Other materials. Cladding, roofing, linings, fixings and other elements are not included unless your quote says so.

10. Support

We supply frames. We do not install them. Installation is carried out by you or your builder.

Each Order includes up to 2 hours of on-call support by phone or video, for questions about the plans, connections and ancillaries.

Further support is available at cost, quoted before we attend. This includes reviewing the plans on site with your builder, checking connections and ancillaries, and being available for frame inspections by the local authority.

Our support is advice only. Your builder remains responsible for installing the frames in line with the approved Drawings, for the building work, and for its compliance with the Building Code.

11. Warranty, defects and statutory rights

We warrant that goods will be manufactured to your approved Drawings and will be free from defects in materials and manufacture for 12 months from delivery.

Our frames are made from Axxis® steel by New Zealand Steel, which provides a 50-year Durability Statement for it. That statement is New Zealand Steel’s, not a warranty given by SFML, and it applies only where the steel is installed, used and maintained within the conditions set out in New Zealand Steel’s Durability Statement.

Products from other suppliers. Some products we supply, such as cladding, roofing, ancillaries and fixings, are made by other companies. We supply them to the manufacturer’s specification. Their performance, durability and warranty are those given by the manufacturer, and our manufacturing warranty above does not extend to them. If a product is faulty, tell us promptly. We will help you make a claim under the manufacturer’s warranty, and we will remedy the fault ourselves where the law requires us to. You must install and maintain these products to the manufacturer’s instructions, or their warranty may not apply. Nothing in this paragraph limits your statutory rights.

If goods are defective, tell us promptly with photos and your order details. We may inspect the goods. We will repair or replace the defective item at our option, or refund you if we cannot do either within a reasonable time.

The warranty does not cover damage or defects caused by:

  • incorrect storage or handling, or exposure to wet concrete, treated timber or other corrosive materials
  • alterations to the frames not approved by our engineer
  • installation that does not follow the approved Drawings and connection details
  • foundation or site movement, or foundations not built to the design
  • fair wear, fire, flood, earthquake or other events outside our control
  • use of the goods for something other than they were designed for

Consumers. This warranty is in addition to your statutory rights, which these terms do not limit.

Business Customers. To the extent the Consumer Guarantees Act 1993 would otherwise apply, you and we agree in writing that it does not apply to this supply, because it is fair and reasonable for the parties to contract out of it.

12. Limitation of liability

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.

Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of use, or costs caused by delay, whether in contract, tort or otherwise.

If you are a Business Customer, our total liability for any claim arising from an Order is limited to the price you paid for the goods or services the claim relates to.

13. Designs, drawings and models

SFML keeps the intellectual property in our Drawings, 3D models, detailing and Kitset designs. When you pay for an Order, you may use the Drawings for the project they were prepared for. You may not copy them, give them to another manufacturer, or reuse them on another project without our written consent.

If you give us plans or designs, you confirm you have the right to give them to us for use on your Order.

14. Delays and events beyond our control

We are not in breach if we are delayed by events beyond our reasonable control, such as natural disaster, extreme weather, supply chain failure, transport disruption, industrial action or government action. We will tell you promptly and give you a revised date.

If the delay lasts more than 60 days, either of us may cancel the part of the Order not yet manufactured or delivered. We will refund the price paid for that part, less the cost of work already done on it.

15. Privacy

We collect your name, contact details, site address, project plans and payment information to quote, design, manufacture, deliver and invoice your Order. We handle personal information in line with the Privacy Act 2020. Our Privacy Policy explains what we collect, why, who we share it with, and how to ask for access to or correction of your information.

16. Disputes and governing law

If you have a complaint, tell us in writing at info@steelframeman.co.nz. We will respond within 5 business days and try in good faith to resolve it. If we cannot, you may use any other process the law gives you, including the Disputes Tribunal for eligible claims.

These terms are governed by New Zealand law. The New Zealand courts have non-exclusive jurisdiction.

17. General and contact details

These terms, together with your quote, invoices and any signed contract, are the whole agreement between us for the Order. A change to them is effective only if SFML agrees in writing.

If a term is found unenforceable, the rest still applies. A delay in enforcing a right is not a waiver of it. We may use subcontractors to manufacture or deliver, and remain responsible to you for their work. Notices may be given by email to the address you gave us or to info@steelframeman.co.nz. Accepting by email, online checkout or electronic signature binds you as if you had signed on paper.
